The petitioner alleges that respondent no. 7, a member of the said Gram Panchayat, remained absent from three consecutive meetings of the Panchayat and, accordingly, the petitioner submitted a representation dated December 20, 2024 before the prescribed authority seeking removal of respondent no. 7. It is the grievance of the petitioner that no steps have been taken pursuant to the said representation dated December 20, 2024. Learned counsel appearing for the State, on instruction, submits that respondent no. 7 was not duly notified of the relevant three consecutive meetings. 2 This Court, however, is not inclined to adjudicate the issue on merits. The Sub-Divisional Officer, being the Prescribed Authority, is the competent authority to take a decision in this regard. Accordingly, the writ petition is disposed of with a direction upon the Sub-Divisional Officer, Diamond Harbour Sub-Division, to take steps in accordance with law on the petitioner’s representation dated December 20, 2024, within a period of three months from the date of communication of this order. Accordingly, WPA 3995 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
