For Non-Applicant : Mr. Jitendra Shrivastava, G.A. NIRMALA RAO 2 Hon’ble Shri Justice Rakesh Mohan Pandey Order on Board 28/09/2026 1. These are the first bail applications filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) for grant of regular bail to the applicants in connection with the Crime No.333/2026, registered at Police Station Masturi, District Bilaspur for the offences punishable under Sections 318(4) and 61(2)(b) of BNS. 2. The case of the prosecution, in brief, is that between 28.9.2016 and 20.2.2026, the applicants, namely, Govind Singh Uike, “Bank Cashier”, and Avinash Bandhe, “Proprietor of Grahak Seva Kendra”, opened Kisan Credit Card accounts, sanctioned loans in the names of 21 innocent farmers and subsequently withdrew the amounts from their accounts. During the course of investigation, the police seized eight KCC loan forms, withdrawal forms bearing the signatures of the victims, their Aadhaar cards, PAN cards and other signed KCC loan forms. Subsequently, the offence, as stated above, was registered and the applicants allegedly committed fraud to the tune of Rs.97,37,331/-. 3. Shri Pradeep Modi, learned counsel for applicant Govind Singh Uike, would submit that the applicant was transferred on 9.6.2023, whereas the forged loan accounts had been opened prior to the said date, with effect from 28.9.2016. He would further submit that the charge-sheet has already been filed and that the applicant is in jail since 4.6.2026. He would, therefore, pray for grant of regular bail to applicant Govind Singh Uike. Ms. Chandra Kumari Nawrang, Advocate, would submit that applicant Avinash Bandhe has also been implicated in the present 3 case, whereas the bank accounts were opened by the bank authorities and there no role was played by applicant Avinash Bandhe. She would pray for grant of bail to applicant Avinash Bandhe. 4. On the other hand, learned State counsel opposes the bail applications filed by the applicants in both the cases. 5. Heard learned counsel appearing for the parties and perused the case diary. 6. Having considered the fact that the present applicants allegedly cheated 21 innocent farmers and opened their Kisan Credit Card accounts and sanctioned loans totalling Rs.97,37,331/-, and that the police seized blank KCC loan forms, withdrawal forms bearing the signatures of the farmers, their Aadhaar cards, PAN cards and other documents, I am not inclined to allow the bail applications filed by the applicants. 7. Accordingly, the bail applications of the applicants filed under Section 483 of BNSS, 2023 are rejected. Sd/- Rakesh Mohan Pandey JUDGE Nimmi
