Rakib (Allowed) CRM (M) 641 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Hanskhali Police Station case no. 847 of 2025 dated 26.10.2025 under Sections 129(3)/117(2)/118(2)/109(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and added Section 103(1) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Juhurali Mandal. ……Petitioner. Ms. Minoti Gomes Mr. Samrat Paul ……for the Petitioner. Mr. Sandipp Chakraborty Ms. Sonali Bhar ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for about five months. There was a land dispute between the family of the petitioner and that of the de-facto complainant. Petitioner is 65 years old and as charge-sheet has been submitted further detention of the petitioner is unwarranted. Learned advocate for the State opposes the prayer for bail and submits that petitioner and another along with others indiscriminately assaulted the deceased with the bamboo stick. Having considered the materials in the Case Diary which reflects that there was a land dispute between the family of the petitioner and the cousins which is the genesis of the present incident and the petitioner having no criminal antecedents, I am of the opinion that further detention of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed. 2 Accordingly, petitioner namely, Juhurali Mandal shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Ranaghat, Nadia. If on bail, the petitioner shall appear before the learned Magistrate on each and every date and shall not leave the Sub-division of Ranaghat without the prior permission of the Additional Chief Judicial Magistrate, Ranaghat, Nadia. Petitioner shall once in a week meet with the Officer-in-Charge of Hanskhali police Station till further orders of this Court. Accordingly, CRM (M) 641 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
