...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue appropriate Writ, Order, or Direction, more particularly one in the nature of a Writ of Mandamus, declaring the action of the respondents in not considering the candidature of the petitioner for promotion to the post of Deputy Mandal Parishad Development Officer in the Panchayat Raj and Rural Development Department solely on the ground of pendency of Charge Memo No. 6567/CPR and RD/B1/2015 dated 06.03.2017 relating to incidents of the years 2013-14 and Charge Memo No. 871/CPR and RD/B1/2014 dated 26.02.2016 issued by the 2nd respondent, as illegal, arbitrary, unreasonable, violative of Articles 14 and 16 of the Constitution of India, contrary to the principles of natural justice and the law laid down by this Honble Court and the Honble Supreme Court and consequently direct the respondents to consider the candidature of the petitioner for promotion to the post of Deputy Mandal Parishad Development Officer in the existing vacancies without reference to the aforesaid pending charge memos, in terms of G.O.Ms.No.257 dated 10.06.1999, and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents to consider the candidature of the petitioner for promotion to the post of Deputy Mandal Parishad Development Officer in the Panchayat Raj and Rural Development Department against the existing vacancies, without reference to Charge

The present writ petition is filed questioning the action of the Respondents in not considering the candidature of the Petitioner for promotion to the post of Deputy Mandal Parishad Development Officer in Panchayat Raj and Rural Development Department on the ground of pendency of charge memo dated 06.03.2017 pertaining to the year 2013-14 as illegal and arbitrary. 2. Sri M. Ramprasad, learned counsel for the Petitioner submits that pursuant to the departmental enquiry dated 06.03.2017, punishment was imposed. 3. In that view, the cause in the writ petition does not survive and the writ petition is closed. No order as to costs.
