A.S.Roy ..for the respondent nos. 8 & 9 Heard learned counsels for the parties. It appears from the supplementary affidavit submitted by the petitioner that the Pradhan has considered the representation submitted by the private respondent and has passed an order on August 17, 2026. The order has been communicated to the Sub-Divisional Officer on August 27, 2026. On the prayer of the petitioner, liberty is granted to appear before the Sub-Divisional Officer in the hearing to be conducted by him under Section 23(5) of the West Bengal Panchayat Act, 1973 and place relevant documents in support of his contention. It is made clear that this Court has not dealt with the merits of the case and the Sub-Divisional Officer is at liberty to deal with the entire issue and pass a reasoned order upon granting reasonable opportunity of hearing to the parties, in accordance with law. Nothing further remains to be dealt with in the present petition in view of the submission made on behalf of the petitioner. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
