1 CGHC010335662026 2026:CGHC:42523 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 8076 of 2026 Vikas Agrawal S/o. Late Jeevan Ram Agrawal, Aged About 40 Years R/o. Village Rajpur (Kusumi Main Road), Police Station And Tehsil Rajpur, District Balrampur - Ramanujganj (C.G.) ... Applicant versus State Of Chhattisgarh Through Police Station Naya Rajpur, District Balrampur - Ramanujganj (C.G.) (As Per F. I. R. Annex. A / 2) (Wrongly Typed As Police Station Rajpur In The Impugned Order) ... Non-Applicant For Applicant : Shri Manoj Paranjpe, learned Senior Advocate assisted by Shri Aditya Dhar Diwan, Advocate. For Non-applicant/State : Shri Kanwaljeet Singh Saini, Deputy G.A. (HON’BLE SHRI JUSTICE RAKESH MOHAN PANDEY) Order on Board 30/09/2026 1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 177/2026 registered at Police Station Naya Rajpur, District Balrampur- Ramanujganj (C.G.), for the offence punishable under Sections 318(4), 336(3) and 3(5) of the Bhartiya Nyay Samhita, 2023 (for short, the BNS). 2. As per the case of the prosecution, an F.I.R. was lodged by the complainant Ramnaresh Singh, Sub-divisional Officer (Revenue), Naya Digitally signed by ALLENA ANJANI KUMAR Date: 2026.09.30 17:56:23 +0530 2 Rajpur on 08.07.2026 against Vinod Kumar Sandilya and Deepak Kumar Sandilya making allegations that they collected Aadhar Cards of residents of village Kundikala and withdrawn fertilizer (urea) in the name of multiple women belonging to the said village. Further, enquiry was also conducted by Nayab Tahsildar, Bariyo and in the said enquiry, it was found that both Vinod kumar Sandilya and Deepak Kumar Sandilya committed forgery. Based on the F.I.R., the aforesaid offences were registered against those accused persons. 3. Learned Senior Counsel for the applicant would contend that the name of the applicant was not mentioned in the F.I.R. and on the basis of memorandum statement of co-accused persons, the present applicant was implicated as an accused. He would contend that charge-sheet has already been filed and the applicant is in jail since 13.08.2026; there is no evidence connecting the present applicant with the commission of crime and that there is no criminal antecedent against the applicant and further, conclusion of the trial is likely to take some considerable time. Therefore, he would pray for grant of bail to the applicant. 4. On the other hand, learned counsel appearing for the State would oppose the bail application and submit that the present applicant supplied 31 tonnes of fertilizer to main accused persons – Vinod Kumar Sandilya and Deepak Kumar Sandilya. He would further submit that as per memorandum statement of the co-accused persons, the applicant received commission to the tune of around Rs.17,000/- - 18,000/-, therefore, the application for bail deserves to be dismissed. 5. I have heard learned counsel appearing for the parties and perused the 3 case diary. 6. Having considered the fact that the applicant was not named in the F.I.R; initially F.I.R. was lodged against Vinod Kumar Sandilya and Deepak Kumar Sandilya, who forged the Aadhar Cards of villagers of Kundikala; the name of the applicant surfaced in the memorandum statement of co-accused persons; there is no seizure from the present applicant; charge-sheet has already been filed and the applicant is in jail since 13.08.2026 and that, he has no criminal antecedent and further conclusion of trial may take some considerable time, I am inclined to grant bail to the applicant. Accordingly, the instant bail application is allowed. 7. It is directed that the applicant be released on bail on his furnishing a personal bond in sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the Court concerned with the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
