In this Writ Petition, petitioners are seeking a direction to the respondent-authorities to consider the representations - 4 - HC-KAR CNR: KAHC010600252026 NC: 2026:KHC:46440 WP No. 26931 of 2026 dated 18.08.2026 and 19.08.2026 submitted by the petitioners as per Annexures - A to C. 2. Sri. Nataraj Baba K., learned counsel appearing for the petitioners contended by referring to the memorandum dated 03.08.2026 (Annexure-G), that, based on the complaint made by private respondents, respondent-authorities are interfering with the land belonging to the petitioners and accordingly, sought for interference of this Court. 3. Per contra, Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for the respondents, submitted that action has been taken pursuant to Annexure-G to remove any encroachment made on public road as per the village map. 4. In that view of the matter, taking into consideration the factual aspects on record, that memorandum dated 03.08.2026 (Annexure-G) has been issued to remove the encroachment as per the village map, I am of the view that, the same has to be done by the respondent-authorities by following due process of law. - 5 - HC-KAR CNR: KAHC010600252026 NC: 2026:KHC:46440 WP No. 26931 of 2026 5. In that view of the matter, respondent Nos.2 to 6 are hereby directed to consider the representations made by the petitioners dated 18.08.2026 and 19.08.2026(Annexures-A to C), in accordance with law and pass appropriate orders at the earliest. 6. It is made clear that the respondent-authorities shall not take any precipitative action against the petitioners or any other person in the guise of interfering with the land belonging to the petitioners / Government, unless by due process of law. 7.
