Hon’ble Shri Justice Rakesh Mohan Pandey Order on Board 28/09/2026
1. The applicants have preferred this first bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for
2 grant of regular bail as they have been arrested in connection with Crime No. 359/2026 registered at Police Station Sakri, District Bilaspur (C.G.) for the offence punishable under Sections 140(3), 308(5) and 3(5) of the Bhartiya Nyay Sanhita, 2023 (hereinafter, “BNS”). 2. The prosecution case, in brief, is that the complainant Sudhir Joshi lodged a written complaint alleging that accused Satish Mishra, along with other co-accused persons, by impersonating themselves as police officials, called the complainant's son Mayank Joshi and his friends, confined and abducted them, threatened them with death and attempted to extort money by intimidation. It is further alleged that on 23.02.2026, Satish Mishra and his associates took Piyush Dhruv and Pranav Mishra in a Scorpio vehicle bearing the word "Police" to an unknown place, while Mayank Joshi and Ujjwal Rana were confined and threatened, and were subsequently taken in an Alto car and dropped at Nehru Chowk. On the basis of the complaint, Crime No. 359/2026 was registered at Police Station Sakri for offences punishable under Sections 140(3), 308(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, and the present applicants have also been implicated in the commission of the alleged offences. 3. Ms. Divya Sahu, learned counsel appearing for the applicants, would submit that the applicants have falsely been implicated in the present case and they are innocent. She would further submit
3 that co-accused persons namely Satish Mishra and Vinay Sahu have already been enlarged on bail by this Court.
She would further contend that the applicants are in jail since 04/06/2026, the charge-sheet has already been filed, and the trial is likely to take considerable time to conclude, therefore, the applicants be enlarged on regular bail. 4. On the other hand, Ms. Laxmeen Kashyap, learned counsel for the non-applicant/State, would oppose the bail application and submit that there are 3 criminal antecedents of applicant No. 1 Yogesh Pandey @ Bhuru and there are 2 criminal antecedents of applicant No. 2 Prabhat Thakur. She would further contend that co-accused Satish Mishra and Vinay Sahu were granted bail by this Court has they had no criminal antecedents. Thus, the applicants are not entitled to grant of regular bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicants, and the fact that the applicants have criminal antecedents which shows that they are habitual offenders and further considering that one case registered in the year 2026 is of similar nature and is still pending before the trial Court and further haivng considered that co-accused Satish Mishra and Vinay Sahu were granted bail by this Court on account of filing of charge-
4 sheet and after considering their period of detention and also considering that they had no criminal antecedents, the facts of the present case are distinguishable and this Court is not inclined to release the applicants on regular bail. 7. Accordingly, this bail application is hereby rejected. Sd/- Sd/-
