(NDPS) 1884 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Suti Police Station Case No. 305 of 2022 dated 28.05.2022 under Sections 20(b)(ii)(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re : Anikul Khan @ Ani Khan ... Petitioner. Mr. Arnab Chatterjee, Mr. Avik Ghosh ... For the Petitioner. Dr. Pradip Banerjee, APP, Ms. Priti Kar Bagchi ... For the State. Learned advocate appearing for the petitioner submits that petitioner is innocent and has been falsely implicated in the instant case. Petitioner was unaware relating to the incident and has been all on a sudden arrested after three and a half years of the case having been registered. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that recovery in the present case is 52 kgs. of Ganja. It has also been brought to the notice of this Court that the petitioner was evading arrest for a considerable period of time and there are 15 other cases so far as the present petitioner is concerned. A list of cases provided in the Memo of Evidence submitted on behalf of the State include not only cases under the NDPS Act, but also under the Arms Act and Explosive Substances Act along with other offences under 2 the BNS. Having considered the antecedents of the present petitioner, I am not inclined to grant bail to the petitioner as the petitioner has avoided the process of law for a considerable period of time. As such, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. A copy of the same be handed over to learned advocate appearing for the petitioner. The application for bail, being CRM (NDPS) 1884 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
