Learned advocate appearing for the petitioner submits that the petitioner has been implicated in the instant case because of certain recoveries of 339 bottles of codeine phosphate solution/cough syrup from an abandoned house of the petitioner. The said house, according to the petitioner, is situated within 500 meters of the border. There are other persons who have been named in the FIR but petitioner’s complicity is to the extent that the house belongs to the present petitioner.
Learned advocate appearing for the State opposes the prayer for bail and submits that the materials appearing in the case
2 diary do fortify the house to be of the present petitioner. Last date was fixed for supply of copies.
Having considered that the recovery was from the house of the petitioner and the petitioner’s claim is that the same is an abandoned house. The same is a question of fact to be decided in course of the trial. At this stage, I am not inclined to release the petitioner on bail.
Accordingly, CRM(NDPS)1892 of 2026 is dismissed.
Memo of Evidence submitted by the State be kept with the record.
