In re : An Application under Section 482 of the BNSS, 2023/under Section 438 of the Cr.P.C. in connection with Burrabazar PS Case No. 66 of 2026 dated 03.05.2026 u/s 108/115(2)/3(5) of the BNS.

In the matter of : Manju Mishra @ Smt. Manju Mishra
… Petitioner(s)
Mr. Milon Mukherjee, Sr Adv. Mr. Usof Ali Dewan Mr. Asif Dewan Mr. Mehedi Masud
… for the petitioner(s)
Mr. Krishnendu Bhattacharya, ld.APP Mr. Koustav Lal Mukherjee Mr. J. Bose
… for the State-respondent(s)
Mr. Mukherjee, learned Senior Advocate, appearing for the petitioner submits that the petitioner has been implicated in the instant case at the behest of the defacto- complainant with whom there were issues relating to a property. State opposes the prayer for bail and submits that in the suicide note, there are certain references. I have taken into account the overall materials appearing in the case diary and I am of the opinion that custodial detention of the present petitioner is unwarranted.
2 Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Manju Mishra @ Smt. Manju Mishra] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner shall make herself physically available before the I.O. of the case as and when she would be required by the I.O. for the sake of investigation. Accordingly, CRM (A) 2894 of 2026 is disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
