Mrs. Mehr Sarah Vs. The State of West Bengal & Ors.
Mr. M.R. Mollah
Ms. Shirin Mustaque
…for the petitioner
Ms. Farnaz Nasim
…for the respondent no. 4
Mr. Suryaneel Das
Mr. Chiranjit Pal
…for the State
1. Affidavit of service filed on behalf of petitioner is taken on record.
2. Learned advocate representing petitioner has questioned dissolution of marriage which has been attempted to be effected by respondent no. 4 being husband of petitioner as it appears from letter dated 21st July, 2026 addressed to concerned police authority.
3. State respondents and respondent no. 4 are represented by learned advocates who have opposed this writ petition on the count that present writ petition is not maintainable since divorce is questioned by filing this writ petition.
4. On perusal of letter dated 21st July, 2026 it appears that divorce as was attempted to be effected by respondent no. 4 is questioned by
2 sending letter to the concerned police authority. Police authority is not the appropriate authority to decide validity and legality of divorce. If petitioner is aggrieved by acts and actions of respondent no. 4 being her husband in that event petitioner needs to take steps in accordance with law questioning divorce.
5. Hence, present writ petition is not entertained and same stands dismissed.
6. However, this order shall not preclude the petitioner to take steps in accordance with law.
7. Parties to act on server copy of this order duly downloaded from the official website of this Court.
