JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: "a. Issue a writ, writ in the nature of Certiorari by quashing the order at Annexure 'A' dated 30.09.2025 passed by the 3rd respondent Deputy Superintendent of Police in reviving the Rowdy Sheet against the petitioner b. Issue a Writ, writ in the nature of Certiorari by quashing the show-cause-notice dated 19.08.2026 bearing No.M.A.G(1)/Externment/08/2026 Annexure 'B' issued by the Special Executive Magistrate and Deputy Superintendent of Police, Mandya District under section 58 of the Karnataka Police Act for removing the person under apprehension about to commit the offence for a unlimited period. - 3 - HC-KAR CNR: KAHC010601412026 NC: 2026:KHC:47064 WP No. 27100 of 2026 C. Grant such other relief or relief's as this Hon'ble Court may deem fit under the facts and circumstances of the case." 2. The submission of learned counsel for the petitioner is that without following Regulation 1059 of the Police Manual, a rowdy sheet has been reopened against the petitioner. The submission of Sri Hareesh Bhandary T. is that before reopening no notice had been issued to the petitioner and that the order dated 30.09.2025 at Annexure-A is not sustainable. His further submission is that in pursuance of the rowdy sheet 30.09.2025, a show cause notice dated 19.08.2026 had been issued under Section 55 of the Karnataka Police Act, 1963. 3. A perusal of the writ papers does not indicate any particular notice having been issued in compliance with Regulation 1059 of the Karnataka Police Manual. That being the case, the rowdy sheet could not have been reopened vide order dated 30.09.2025. 4. Learned AGA submit that the said order dated 30.09.2025 may be read down as a show cause notice directing the - 4 - HC-KAR CNR: KAHC010601412026 NC: 2026:KHC:47064 WP No. 27100 of 2026 petitioner to reply to the same, which would be considered by the respondent in accordance with law. 5. Even if the said submission of the learned AGA is accepted, the show cause notice dated 19.08.2026 at Annexure-B, which has been issued premised on the order dated 30.09.2025, cannot continue. As such, this Court passes the following: ORDER i. The writ petition is allowed; ii. The order at Annexure A dated 30.09.2025 is read down as a show cause notice. iii. The petitioner is at liberty to reply to the same. iv. If such a reply is issued by 17.09.2026, respondent No.3 is directed to consider the same and pass necessary orders in accordance with law. v. Pending passing of the orders on Annexure-A, the show cause notice dated 19.08.2026 is not - 5 - HC-KAR CNR: KAHC010601412026 NC: 2026:KHC:47064 WP No. 27100 of 2026 sustainable. As such, the show cause notice dated 19.08.2026 stands quashed. vi. Reserving liberty to the respondents to pass such orders and or issue such notice as may be required depending on the orders passed on the read down show cause notice at Annexure A dated 30.09.2025.
