Versus The State of West Bengal Mr. Siddhartha Sarkar Mr. Sourav Gupta. …for the petitioners. Mr. Gouranga Kumar Das Mr. Shivam Mishra. …for the State. Learned advocate appearing for the petitioners submits that the petitioners have been foisted with the present criminal case. They are in custody since 13th September, 2025. Learned advocate for the State submits that although 109 bottles of phensedyl were recovered but from each of the present petitioners separate recoveries have been made. Having considered the quantum of recovery in the present case 109 bottles of phensedyl amounting to 10.9 litres, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the petitioners in CRM(NDPS)1870 of 2026 is dismissed. All parties shall act on the server copy of this order duly 2 downloaded from the official website of this Court.
