Learned advocate appearing for the petitioner submits that the petitioner has been arrested in the instant case because the vehicle belongs to his wife. There are no incriminating materials appearing against the present petitioner neither the grounds of arrest specified the reasons for which petitioner has been detained. Charge-sheet has already been submitted and the petitioner is in custody for 1 year 3 months, as such, petitioner may be released on bail as there is no possibility of the trial being taken to its logical conclusion.
Learned advocate for the State opposes the prayer for bail
2 and submits that in the present case there was seizure of 33200 bottles of phensedyl. So far as the vehicle in which the present petitioner was plying the recovery was 15000 bottles of phensedyl.
Having considered the stage of the case and the huge quantity of contraband recovered in the present case and the petitioner being intercepted at the spot, I am not inclined to release the petitioner on bail at this stage.
Accordingly, the prayer for bail of the petitioner in CRM(NDPS)1898 of 2026 is dismissed.
