For Petitioner: Mr.I.Gowri Shankar For Respondent: Ms.R.S.Indira Government Advocate (Crl.Side) ORDER The petitioner apprehends arrest for the alleged offence under Sections 316, 318, 319, 336, 337, 338, 339, 340, 61(2) & 3(5) of BNS Act in Crime No.110 of 2026 on the file of the respondent police seeks anticipatory bail. 2. The case of the prosecution is that, starting from 2023, accused A1 and A2 induced the victims to avail of a Tamil Nadu Housing Board scheme meant for people living below the poverty line, thereby cheating them to the tune of https://www.mhc.tn.gov.in/judis CRL OP No. 14863 of 2026 __________ Page2 of 4 three crore rupees. The specific allegation against this petitioner (A3) is that the petitioner, while impersonating a Housing Board staff member, along with A4 (Vinitha), received a sum of Rs. 46,00,000/- from 46 persons. Hence, the FIR was registered. 3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner. 4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and submitted that unless the petitioner is taken into custody like the other accused, the layering of the money cannot be identified. Hence, he opposed the grant of anticipatory bail to the petitioner. 5. Considering the facts and circumstances of the case and also taking note of the submissions made by the learned Government Advocate (Criminal Side) that unless the petitioner is taken into custody like the other accused, the layering of the money cannot be identified.
