This appeal, preferred under Section 19 of the Family Courts Act, 1984 is filed by appellant-wife challenging the judgment dated 07.10.2024 rendered by Principal Judge, Family Court, Dehradun in Original Suit No.224 of 2024 (Smt. Nitu Kumari Thakur v. Abhishe Kumar Jha). By the said judgment, suit for divorce filed by appellant was dismissed. 4. It is the submission of learned Counsel for appellant that appellant has learnt through an affidavit filed by respondent in this appeal that respondent (Abhishek Kumar Jha) had also filed a suit for divorce before the Family Court, Raipur (Chhatisgarh) which was numbered as Original Case No.681 of 2021, and was decreed ex parte vide judgment dated 10.05.2022. He further submits that appellant also wants divorce and she had also filed suit before the Family Court at Dehradun, and since relief of divorce is now granted by learned Family Court at Raipur (Chhatisgarh) on a suit filed by her husband, therefore, appellant does not want to press this appeal any more, and that appeal be dismissed 2026:UHC:3030-DB as withdrawn. He further submits that the appellant does not propose to file any application for setting aside ex parte decree of divorce given by Family Court at Raipur (Chhatisgarh). 5. Mr. Kamlesh Buddhlakoti, learned Counsel, appearing for respondent, also ratifies the fact that learned Family Court at Raipur (Chhatisgarh) has granted ex parte divorce to the parties in a suit filed by the respondent-husband vide judgment dated 10.05.2022. 6. In the aforesaid background, and in view of the oral prayer made by Mr. B.S. Bhandari, learned Counsel appearing for appellant, the appeal is dismissed as withdrawn. 7.
