None for the respondents. CMP No.2571 of 2026 For the reasons stated in the application, the same is allowed and delay of 18 days in re-filing the appeal is condoned. Application stands disposed off. CMP (M) No.105 of 2026 Despite being duly served none has put in appearance on behalf of the respondents, hence, they are proceeded against exparte. The present application under Section 5 of the Limitation Act has been filed for condonation of delay in filing the present appeal. It has been averred in the application that the impugned judgment and decree was passed by the learned District Judge, Bilaspur on 15.01.2025. On receipt of the communication, the case was forwarded to respondent No.4. i.e. Executive Engineer HPWD Division No.02, Bilaspur, office letter No.11055-56 dated 14.02.2025 for legal opinion. Thereafter, the case was placed before the different authorities and ultimately, the appeal was drafted in the office of learned Advocate General on 03.09.2025 and in this process, the delay of more than 233 days has occurred in filing the present appeal. The reasons as assigned in the application are reasonable and plausible. In view of the submissions as made by the learned counsel for the applicant, the present application is allowed and delay of 233 days in filing the present appeal is ordered to be condoned .
