Affidavit of service filed in Court today is taken on record. The petitioners claim to be the owner of several plots of land within Mouza Chakpurushottampur in the District of Paschim Medinipur. The petitioners allege that the private respondents have erected a construction by encroaching upon the PWD road lying adjacent to the aforesaid property of the petitioners. The petitioners claim to have submitted representation before various authorities praying for removal of the encroachment from the PWD road. However, the appropriate authority authorized to take a decision on such issue under the West Bengal Highways Act, 1964 has not been approached by the petitioners. Heard the learned advocate for the State on such submission.
2 Faced with such situation, the learned advocate appearing for the petitioners prays for liberty to submit an appropriate representation before the appropriate authority under the West Bengal Highways Act, 1964. In the light of the submissions made by the learned advocate for the petitioners, WPA 703 of 2026 stands disposed of by giving liberty to the petitioners to submit a comprehensive representation before the appropriate authority under the West Bengal Highways Act, 1964 and if such a representation is submitted such authority shall consider the same and act in accordance with law. There shall be however no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
