Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 28.09.2026 1)The applicant has preferred this Fourth Bail Application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.639/2021, registered by Police Station Civil Lines, District : Bilaspur (C.G.) for the offence punishable under Sections 21 and 22 of NDPS Act. 2)Case of the prosecution, in brief is that on the basis of information given by the informer, police of Police Station Civil Lines Digitally signed by AJINKYA PANSARE Date: 2026.09.29 10:25:20 +0530 2 conducted and detained the accused persons who were carrying intoxicating syrups and injections. Among the accused was Akash Tandon (the present applicant), from whom a yellow-blue bag containing 28 bottles (100 ml each) of Onrex syrup and Rs. 120/- were recovered. Accordingly, offence was registered against the present applicant and he was arrested. Subsequently, he was enlarged on bail in MCRC/10245/2021 vide order dated 09.05.2022 but he failed to appear before the learned trial Court on subsequent dates of hearing, therefore an arrest warrant was issued against him. In compliance of said order, he was arrested on 23.08.2025 and produced before the learned trial Court, which remanded him to judicial custody. Thereafter, applicant preferred MCRC/1477/2026 which was rejected by the co-ordinate Bench vide order dated 11.02.2026. 3) Learned counsel for the applicant submits that earlier, applicant was enlarged on bail in MCRC/10245/2021 and he regularly appeared before the learned trial Court. However, due to improper follow-up and miscommunication with his local counsel, he could not appear before the learned trial Court and arrest warrant was issued against him. She further submits that trial is progressing at a slow pace as only 01 witness out of 13 witnesses have been examined till date whereas applicant, who has no previous criminal antecedent is languishing in jail since 23.08.2025. She prays to allow this bail application. 3 4)On the other hand, learned counsel for the State opposes the bail application. He submits that the applicant was re-arrested on account of his non-appearance before the learned trial Court, and there is a risk of him absconding, therefore, he is not entitled to be released on bail. 5)I have heard learned counsel for the parties and perused the case diary. 6)Evidently, applicant was enlarged on bail in MCRC/10245/2021 vide order dated 09.05.2022 but he jumped the bail during trial and absconded. He did not appear before the learned trial Court for three long years and subsequently he was arrested on 23.08.2025. 7)Considering the nature and gravity of the offence alleged against the applicant, coupled with the fact that he had earlier jumped bail, as well as the fact that his previous bail applications have been rejected on merits vide orders dated 29.10.2021, 08.12.2025, and 11.02.2026, this Court is not inclined to extend the benefit of bail to the applicant. 8) Accordingly, the instant bail application is rejected.
