02.09.2026 Serial no. 82 [G.S.Das] Assistant Registrar (Court) CRM (NDPS) 1877 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Nabagram PS Case No. 111 of 2025 dated 23.02.2025 u/s 20(b)/29 of the NDPS Act. -And- In the matter of : Birendra Barman &Anr. … Petitioner(s) Mr. prajnadeepta Roy Ms. Sohini Kundu Mr. Sabir Ali Mr. Debojyoti Goswami … for the Petitioner(s) Mr. Soumak Bera Ms. Pramita Banerjee … for the State-respondent(s) The petitioners are in custody since 23rd February, 2025; the evidence of the seizure list witnesses are completed and some time will be required to take the trial to its logical conclusion. Learned advocate, as such, prays that the petitioners may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that independent witnesses have supported the prosecution’s case and the quantum recovered in the present case is of commercial quantity being 227.98 kg of ganja. 2 Having considered the huge quantum of seizure, I am of the view that the petitioners have failed to overcome the rigors of Section 37 of the NDPS Act. Hence, the prayer for bail of the petitioners is Rejected. Accordingly, CRM (NDPS) 1877 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
