Respondent Prayer : Criminal Original Petition filed under Section 528 of B.N.S.S, to call for the entire records connected with the case in F.I.R No.67 of 2025, on the file of the respondent Police and quash the same insofar as the petitioners are concerned. 3/7 https://www.mhc.tn.gov.in/judis Crl.O.P.No.14441 of 2026 For Petitioners : Mr.S.Sathia Chandran For Respondent : Mr.R.Rajasekaran, Counsel for Government of Tamil Nadu (Criminal Side) ORDER The present Criminal Original Petition has been filed seeking to quash the F.I.R. in Crime No.67 of 2025 dated 23.04.2025 on the file of the respondent Police. 2. The case of the prosecution is that on 23.04.2025, at around 10.20 A.M, the petitioners, along with 583 others, under the leadership of one Abdul Samad, unlawfully assembled near Madharakuppam old bus stop and held a protest against the bill introduced by the Government to amend the Wakf Act. Therefore, an F.I.R is registered in Crime No.67 of 2025 on the file of the respondent Police. 3. Learned Counsel appearing for the petitioners submitted that the facts of the instant case are similar to the facts of the cases in Jeevanandham and others vs. The Inspector of Police, Velayuthampalayam Police Station, Karur District reported in (2018 2 4/7 https://www.mhc.tn.gov.in/judis Crl.O.P.No.14441 of 2026 LW (Crl) 606) and Sri Raja vs Inspector of Police, Sivakasi Town Police Station Virudhunagar District and others (Crl.O.P(MD) No.7922 of 2019, decided on 30.08.2019), in which the proceedings were quashed. Hence, he prayed to quash the proceedings pending against the petitioners. 4. Learned Counsel for Government of Tamil Nadu (Criminal Side) for the respondent Police endorses the aforesaid submission. 5. Heard the learned Counsel appearing on either side and perused the materials available on record. 6. In view of the above, this Court is of the opinion that the above said decisions would apply on all force to the present case and that no useful purpose will be served by keeping the proceedings pending and is liable to be quashed. 7. Accordingly, the Criminal Original Petition stands allowed and the F.I.R. in Crime No.67 of 2025, pending on the file of the first respondent Police, is quashed as against the petitioners. The petitioners are discharged from all charges.
