1 CGHC010362612026 2026:CGHC:42756 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 8769 of 2026 * - Indra Guleri S/o Sukrit Aged About 29 Years R/o Village Risda, Police Station - Masturi, District- Bilaspur (C.G.) ... Applicant Versus * - State Of Chhattisgarh Through Station House Officer, Police Station - Mulmula, District - Janjgir Champa (C.G.) ... Non-Applicant And MCRC No. 8849 of 2026 * - Manish Singh Baldev S/o Mannu Singh Baldev Aged About 25 Years R/o Village- Bhadaura Police Station- Masturi, District- Bilaspur (C.G.) ... Applicant Versus * - State Of Chhattisgarh Through- The District Magistrate, Janjgir-Champa District- Janjgir-Champa (C.G.) ... Non-Applicant For Respective Applicants : Mr. Chandra Prakash Lahrey and Mr. Pragalbha Sharma, Advocate For Non-Applicant : Mr. Jitendra Shrivastava, Government Advocate with Mr. Sourabh Sahu, Panel Lawyer Hon’ble Shri Justice Rakesh Mohan Pandey Order on Board 01/10/2026 1. As both are the first bail applications under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 preferred by the respective applicants Digitally signed by RAMESH KUMAR VATTI Date: 2026.10.01 18:33:37 +0530 2 arise out of the same Crime No. 336/2026 registered at Police Station Mulmula, District Janjgir-Champa (CG) for commission of offence punishable under Sections 331(4), 305(a) and 3(5) of BNS, therefore, they are being disposed of by this common order. 2. As per case of prosecution, the present applicants alongwith other co- accused committed theft of DJ equipments like sound-box, amplifier, one domestic HP cylinder etc. amounting Rs.1,40,000/- on 21.08.2026 from house of the complainant. F.I.R. was lodged and during course of investigation, the applicants and other co-accused were taken into custody and on their instances stolen articles were recovered. 3. Learned Advocates appearing for the respective applicants would submit that the applicants are innocent persons and they have falsely been implicated in the case. They would contend that charge-sheet has already been filed and the applicants are in jail since 25.08.2026. It is also argued that there is one criminal antecedent of applicant- Indra Guleri which was registered in the year 2017 and one criminal antecedent of applicant- Manish Singh Baldev was registered under Sections 281, 125(a) and 106(1) of BNS in the year 2026 and there is no criminal case pending of similar nature. Thus, they would pray for grant of bail to the applicants. 4. On other hand, learned Government Advocate and Panel Lawyer appearing for the non-applicant would oppose. They would submit that the present applicants have criminal history and they committed theft in the house of the complainant and stolen articles were recovered from their exclusive possession, therefore, both the bail applications deserve to be rejected. 3 5. I have heard learned counsel for the parties and perused the case diary. 6. Having considered the fact that one case for commission of offence under Sections 354 & 454 of IPC was registered against applicant- Indra Guleri in the year 2017 and one case under Sections 281, 125(a) and 106(1) of BNS is pending consideration against applicant- Manish Singh Baldev; charge-sheet has already been filed, they have no criminal record of similar nature, they are in jail since 25.08.2026 and further conclusion of the trial is likely to take some time, therefore, without commenting anything on merits of the case, I am inclined to grant regular bail to the applicants. Accordingly, all the bail applications are allowed. 7. It is directed that in the event of each of the applicants executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned Trial Court, they shall be released on bail, on following conditions :- I. They shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such fact to the Court; II. They shall not act in any manner which will be prejudicial to a fair and expeditious trial; III. They shall appear before the trial Court on each and every date given to them by the said Court till the disposal of the trial; and, IV. They shall not involve themselves in any offence of a similar nature in future. 4 8. The observation made in the course of this order is only for considering the case of the applicants on the applications for the grant of regular bail. The concerned trial Court shall not be influenced or bound by any observation made in the course of this order. 9. Certified copy as per rules. Sd/- (Rakesh Mohan Pandey) Judge vatti
