1. The matter is appearing in the today’s cause list under the heading ‘To Be Mentioned’ at the instance of the petitioner. Learned counsel for the petitioner draws my attention to the paragraphs 3 and 4 of the supplementary affidavit along with petitioner for withdrawal filed by the petitioner and submits that since vires of challenge has already been settled by Hon’ble Supreme Court against the petitioner vide in its judgment dated March 9, 2021, passed in Canon India Pvt. Ltd. vs. Commissioner of Customs reported in (2021) 18 SCC 563 and subsequently in judgment dated November 7, 2024, in a matter Commissioner of Customs vs. Canon India Pvt. Ltd. reported in (2025) 4 SCC 509, the instant matter becomes infructuous and the learned counsel for petitioner prays for withdrawal of this writ application.
2. The other side has no objection.
3. In view of the prayer made on behalf of the petitioner and the afore-mentioned judgments passed by the Hon’ble Supreme Court, the instant writ application is dismissed as withdrawn.
4. Interim order, if any, stands vacated.
5. There shall be no order as to costs.
