In Re: An application for Bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Krishnaganj Police Station Case No.70 of 2026 dated 22.02.2026 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985;
Hatem Mondal Versus The State of West Bengal
Mr. Paretha Sarathi Mondal Mr. Tapas Kumar Paul. …for the petitioner.
Mr. Rajendra Banerjee Mr. Jnip Bose. …for the State.
Learned advocate appearing for the petitioner submits that the petitioner is innocent and has been falsely implicated in connection with the instant case on the basis of statement of co- accused.
State opposes the prayer for bail and submits a report. Report reflects that there are three criminal cases against the present petitioner being Krishnaganj P.S. Case No.223 of 2014, Krishnaganj P.S. Case No.142 of 2021 and Krishnaganj P.S. Case No.274 of 2025.
Learned advocate for the petitioner submits that there is another NDPS case where the petitioner is on bail.
Having regard to the overall circumstances particularly
2 the antecedent of the present petitioner, I am not inclined to grant bail in a case where commercial quantity of Eskuf Cough Syrup was recovered though from another accused.
Accordingly, CRM(NDPS) 1868 of 2026 is dismissed.
Report submitted by the State be kept with the record.
