Notice to respondent no.5 is dispensed with in view of proposed order to be passed. 3. Petitioner is before this Court seeking for the following reliefs: a. Issue an order, direction, writ or any appropriate order, writ in the nature of mandamus directing the respondents 1 to 3 to terminate KSK Retail Outlet Dealership with the 5th respondent. b. Issue an order, direction, writ or any appropriate order, writ in the nature of mandamus directing the 5th respondent to restore possession of the Schedule Property to the petitioner. c. Issue an order, direction, writ or any appropriate order, or an order to the respondents 3 to 4 to cease supply of petroleum, remove underground tanks, other equipment form the Schedule Property. d. Issue an order, direction, writ or any appropriate order, writ in the nature of mandamus directing the 4th respondent to initiate necessary action against the 5th respondent in accordance with the - 4 - HC-KAR CNR: KAHC010505422026 NC: 2026:KHC:46593 WP No. 23016 of 2026 Petroleum Act, 1934 read with the Petroleum Rules, 2002. e. Such other reliefs as this Hon'ble Court deems fit in the facts and circumstances of the case. 4. The grievance of the petitioner is that the representation submitted by the petitioner, who is the landowner on which respondent no.5 is running a petrol bunk, has not been considered. The contention taken in the representation is that there is no right for respondent no.5 to run the said petrol bunk since the petitioner/landowner has objected to such use of the land after the expiry of the license. 5. Even if that be so, a representation of this nature cannot be considered. The rules provided under Rule 150 of the Petroleum Rules, 2002, for a particular application to be filed. If such an application is filed by the petitioner before the Deputy Commissioner, the Deputy Commissioner is directed to consider the same and pass necessary orders. 6.
