Respondent(s) (Cause title taken from CIS) For Petitioner(s) : Shri Aditya Khare, Advocate For Respondent(s) : Shri Shahil Singh, Panel Lawyer (HON’BLE SHRI JUSTICE BIBHU DATTA GURU) Order on Board 01.10.2026
1. Learned counsel for the petitioner submit that the earlier writ petition was decided vide order dated 19.08.2025 i.e. the WPS No. 3241/2017 which was filed by the petitioner seeking following reliefs:-
“ 10.1 That this Hon’ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner to take charge of his office in the post of dresser before respondent no. 6 as per the order of the appellate authority i.e. respondent No. 3 dated 27.04.2017. 3 10.2 This Hon’ble Court may kindly be pleased to direct the respondent authorities to pay the salary to the petitioner. 10.3. That, the Hon’ble Court may kindly be pleased to grant any other relief, as it may deem-fit and appropriate”
2. The said writ petition was disposed of vide order dated 19.08.2025 observing thus:
“That the petitioner admittedly remained absent from duty for more than five years, and the competent authority has already proposed the initiation of a departmental enquiry against him , this Court is not inclined to grant any relief. Accordingly the petition stands disposed of with a direction to the competent authority to conclude the departmental enquiry, if initiated, expeditiously, preferably within a period of six months from today.”
3.
After disposal of the aforesaid writ petition, the petitioner filed contempt proceedings, being Cont. No. 529/2026, which was subsequently withdrawn with liberty to file a fresh contempt
4 petition. However, instead of availing the said liberty, the petitioner, without filing any fresh contempt petition, again approached this Court by filing WPS No. 4967/2026, which was also withdrawn with liberty to pursue the representation stated to be pending before the competent authority. It is pertinent to note that the petitioner has not disclosed the fact of the aforesaid earlier proceedings in the present petition and, despite having already approached this Court in respect of the same grievance, is once again attempting to re-agitate and argue the very same issue before this Court. Learned counsel for the petitioner has also failed to point out any subsequent event or fresh cause of action warranting interference by this Court. In view of the aforesaid circumstances, the present writ petition, seeking substantially the same relief on the same cause of action, is not maintainable. 4. Accordingly, the writ petition is dismissed. Sd/- (BIBHU DATTA GURU)
