None appears for the defendant. Prayers from the master summons are quoted below:- a) An order be passed that the suit being C.S. (COM) 21 of 2026 together with application filed under Order XII Rule 6 of the Code of Civil Procedure, 1908 be permitted to be withdrawn as the disputes between the parties have been settled; b) Ad-interim orders in terms of prayer above; c) Such further and/or other order or orders be passed and/or direction or directions be given as Your Lordship may deem fit and proper. 2 IA NO. GA-COM/2/2026 In CS-COM/21/2026 A.R.,J The relevant averments from the supporting affidavit in support of the prayers are quoted below: “9) In view whereof, the obligation of the guarantor under the settlement agreement dated 7 August 2024 stands discharged. Therefore, no sum is due and payable by the respondent to the petitioner herein. 10) In the aforesaid facts and circumstances, the plaintiff/ petitioner humbly states and submits that the suit being CS (COM) No. 21 of 2026, together with the application filed under Order XII Rule 6 of the Code of Civil Procedure, 1908 being IA G.A. (COM) NO. 1 of 2026, be permitted to be withdrawn as the dispute between the petitioner and the respondent have been settled.” In view of the above, the instant civil suit CS-COM/21/2026 stands dismissed, as withdrawn since the disputes between the parties have been settled. Consequently, the connected application IA GA-COM/1/2026, after being treated as on day’s list, also stands dismissed. Accordingly, IA GA-COM/2/2026 stands allowed, without any order as to costs.
