By way of the present writ petition, the petitioner seeks a direction for release of the arrears of salary for the period from 09.06.2025 till 19.02.2026, i.e. the date on which he was permitted to join at JYOTI SHARMA Digitally signed by JYOTI SHARMA Date: 2026.10.01 15:55:55 +0530 2 the new place of posting i.e. Government Higher Secondary School, Khondhar, Block Dabhra, District Sakti, 2. Learned counsel for the petitioner submits that pursuant to the rationalisation scheme, by order dated 7.6.2025 the petitioner was posted at Government U.M. School, Phirid, Block Malkharoda, District Sakti and for which he was relieved on 9.6.2025. However, as no post was vacant at the transferred place,he cannot join. Thereafter, the Directorate of Public Instructions (DPI) took a decision permitting the petitioner to join at Government Higher Secondary School, Khondhar, Block Dabhra, District Sakti, on 19.02.2026. It is, therefore, prayed that the salary for the intervening period be released in favour of the petitioner. 3. Learned State counsel by placing a copy of the letter dated 29.09.2026 issued by the District Education Officer, Sakti, addressed to the Principal,Government Higher Secondary School, Khondhar, Dabhra, District Sakti, submits that necessary instructions have already been issued for release of the salary of the petitioner for the period from 09.06.2025 to 20.02.2026 and that the same shall be released within a period of 15 days. Copy of the said letter is taken on record. 4. Having heard learned counsel for the parties and having perused the material available on record, this Court finds that the grievance of the petitioner is being addressed by the respondents. 5. In view of the aforesaid submission made by learned State 3 counsel, the present writ petition is disposed off with a direction to the State to release the salary of the petitioner for the subject period within a fortnight, as stated by the learned counsel for the State. However, liberty is reserved in favour of the petitioner to revive the present petition in case the salary is not released within the stipulated period or any further cause of action arises.
