The petitioner sought for writ in the nature of mandamus to direct respondents No.2 and 3 to consider the representations dated 20.07.2026 and 17.08.2026 (Annexure-A and B) and regularise a site measuring 2,000 square feet in

Sy.No.61/2 of Kembathalli Village, Uttarahalli Hobli, Bengaluru South Taluk, which is part of Anjanapura further extension. 2. The petitioner contends that out of 3 acres 2 guntas in Sy.No.61/2 of Kembathalli Village, an extent of 2 acres was notified by respondent No.1 for formation of further extension of Anjanapura layout vide final notification dated 07.02.2002. The remaining extent of 1 acre 2 guntas was not notified. The owner of the land in Sy.No.61/2 alienated 9 guntas of land in favour of one Smt. Rathnamma and Venugopal in terms of sale dated 02.08.2004 and consequently, the names of Rathnamma and Venugopal were entered in the revenue records in respect of 9 guntas. Out of 9 guntas, Smt. Rathnamma and Venugopal sold Site No.1, measuring 2,000 square feet, in favour of the petitioner vide sale deed dated 08.06.2011. The petitioner claims that she has enclosed the aforesaid property by a compound and availed electricity and water connection. She contends that respondent No.2 without following the due process of law and without acquiring the remaining 1 acre 2 guntas in Sy.No.61/2, had formed site Nos.491 and 458 in the site purchased by the petitioner. The petitioner, therefore,

submitted two representations requesting the respondents to regularise the purchase of Site No.1 in Sy.No.61/2 of Kembathalli Village and submits that the said representations were not considered and therefore seeks for a direction. 3. The learned counsel for the petitioner reiterated the aforesaid submissions and contended that 9 guntas of land where Site No.1 was conveyed to the petitioner was not acquired and therefore the respondents are bound to regularise the purchase of Site No.1 in Sy.No.61/2 Kembathalli Village by considering her representations dated 20.07.2026 and
17.08.2026. 4.
Learned counsel for the respondents, after securing instructions, submitted that a spot inspection of the land purchased by the petitioner would be conducted and thereafter, if the petitioner is entitled for regularisation, the same would be considered in accordance with Section 38(D) of the Bangalore Development Authority Act, 1976. 5. In view of the aforesaid submission, this Court passes the following:

ORDER i. The writ petition is disposed of; ii. Respondents No.2 and 3 are directed to consider the representations dated 20.07.2026 and
17.08.2026. If need arises, the respondents shall conduct an inspection to find out whether the site purchased by the petitioner lies within 1 acre 2 guntas that was excluded from acquisition in Sy.No.61/2 of Kembathalli Village. iii. If there are any constructions put up on the site purchased by the petitioner and if the petitioner qualifies for regularization under Section 38(D) of the Act, it is open for respondents No.2 and 3 to consider the case of the petitioner in accordance with Section 38(D) of the Act. iv. This exercise shall be completed within a period of three months from the date of receipt of certified copy of this order.
