Accused No.1 in Crime No.209/2026 registered by Chintamani Rural Police Station, Chikkaballapura, for the offences punishable under Sections 115(2), 118(1), 109(1), 329(4), 352, 351(2) and 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.209/2026 was registered by Chintamani Rural Police Station, Chikkaballapura, against petitioner and two others based on the first information dated 16.06.2026 received from Sudhakar, S/o Shivanna. During the course of investigation of the case, petitioner was arrested on 20.07.2026 and remanded judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.206/2026 was rejected on 31.07.2026. Therefore, he is before this Court. - 3 - HC-KAR CNR: KAHC010541112026 NC: 2026:KHC:46718 CRL.P No. 11837 of 2026 4. Perusal of the first information would go to show that first informant and petitioner herein had earlier fought against each other and a case was registered against the first informant. Therefore, they had ill-will against each other. On 15.06.2026, when the first informant was in his house with his parents, petitioner and two others, who came to the house allegedly abused and assaulted the inmates of the house. Accused Nos.2 and 3 in this case have been granted anticipatory bail in Crl.P.No.10825/2026. In paragraph No.4 of the order passed in Crl.P.No.10825/2026, it is observed as follows:- "4. … In the FIR, offences punishable under Sections 115(2) and 118(1) of BNS, 2023, are invoked along with other offences and it is also mentioned that victim has suffered minor injuries. Though learned HCGP has been granted sufficient time to produce the wound certificate, he has failed to produce the same as on this date. It is not in dispute that petitioners do not have criminal antecedents. A reading of the spot panchanama would go to show that weapons used to commit the offences has been already recovered and seized in the present case. Learned counsel for the petitioner has submitted that petitioner has no other criminal antecedents. Major portion of investigation is already completed. Under the circumstances, the following order:- 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.209/2026 registered by Chintamani Rural Police Station, Chikkaballapura, for the offences punishable under Sections 115(2), 118(1), 109(1), 329(4), 352, 351(2) and 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - HC-KAR CNR: KAHC010541112026 NC: 2026:KHC:46718 CRL.P No. 11837 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE DN List No.: 1 Sl No.: 84
