This is second bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 75/2025registered at Police Station Sarangarh, Distt. Bilaigarh- Sarangarh CG) for the offences under Sections 296 of BNS, 191(2). 101(3), 190, 109, 103(1) of BNS and Sections 25 and 27 of the Arms Act. 2 2. The first bail application has been rejected on merits by order dated 21.07.2025 passed in MCRC No.5495. 3. As per the prosecution case, on 13.02.2025, the applicants hurled abuses in front of the shop of complainant Salman Ansari and at the same time, one boy came there having stick and assaulted the complainant. It is also alleged that the applicants and other accused assaulted the complainant using filthy language and one co-accused fired the pistol, due to which, Mukhlal Manjhi sustained a gun shot injury on his chest and died. Complainant Salman Ansari also sustained grievous injuries in the said assault. Based on this offence has been registered against the present applicants along with other co-accused persons. 4. Learned counsel for the applicant submits that though it is a case of injured/eye-witnesses to the incident, but they have not directly supported the prosecution case in their statements. He further submits that the applicants are ladies and are in jail since 14.02.2025; after rejection of first bail application till date out of 36 witnesses, only 8 have been examined and there is no immediate possibility of disposal of the case, therefore, there is changing circumstances in this case. He prays that considering all these aspects, the applicants may to be released on bail. 5. Per contra, learned State Counsel submits that the FIR clearly speaks of the names of these two applicants. On the disclosure of main accused Krishna, the seizure of pistol was made from the house of applicant Gauri Bareth. He further submits that the bail of similarly placed accused Pintu Jangde and Pankaj Vaare have been rejected by this Court by orders dated 04.05.2026 & 28.07.2025 passed in MCRC Nos. 3866 of 2026 & 5622 of 2025 respectively. Therefore, considering the nature of offence, the applicants do not deserve to be released on bail. 3 6. Having considered the submissions made by learned counsel for the parties and the gravity of offence and since no changing circumstances are found after rejection of the first bail application, I am not inclined to allow this second bail application. Accordingly, it is rejected. 7. Earlier this court while rejecting of bail application of co-accused Pintu Jangde directed the trial Court to conclude the trial as early as possible. However, there is lack of progress in trial. Therefore, looking to the long custody of the applicants and treating it as an exceptional matter, the trial Court is directed to expedite the trial as early as possible preferably within a period of 4 months from the date of receipt of copy of this order. 8. A copy of this order be sent to the trial Court for necessary information. Cc as per rules.
