Order on Board
29/09/2026
1. The applicant has preferred this First Bail Application under Section 483 of the BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 377/2026, registered at Police Station Balco Nagar, District – Korba (C.G.) for offences punishable under Sections 119(1), 296, 115(2), 351(3), 324(4), 119(2), 126(2), and 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023. 2. The case of the prosecution, in brief, is that on 24.06.2026, the complainant Bhagatram Vishwakarma lodged a written report at Police Station Balco Nagar alleging that the applicant along with other co- accused persons intercepted a Tanker vehicle bearing registration No. CG-12-S-0164 and demanded Rs. 500/- for purchasing liquor from the driver. Upon his refusal, the applicant and co-accused persons
2 allegedly assaulted the driver, namely Mahendra Chandra, with a belt and stick, causing injuries to him. Based on the said report, the police registered Crime No. 377/2026 against the applicant and other co- accused persons and subsequently arrested the applicant. 3. Learned counsel appearing for the applicant would submit that the applicant is innocent and has falsely been implicated in the present case. He would submit that the applicant is a 22-year-old youth working as a labourer, and a dispute arose over the demand of wages after completion of work which led to hot talks, following which a false and concocted report was lodged. It is further submitted that the applicant and the complainant reside in the same locality; the injured sustained injuries which, as per the MLC report, are not life-threatening (with only one fracture reported); the investigation is complete and the charge-sheet has already been filed before the competent court; the applicant has no criminal antecedents and is in jail since 09.08.2026; and the conclusion of the trial is likely to take some time. Therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, the learned State counsel would oppose the bail application filed by the applicant and submit that the applicant along with other co-accused persons intercepted the vehicle, demanded money, and assaulted the driver with a belt and stick resulting in fracture injury; however, she does not dispute the fact that the charge- sheet has already been filed and that the applicant has no previous criminal antecedents. 5.
I have heard the learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicant, the role attributed to him, and the fact that the applicant has no criminal antecedents; also considering the fact that both parties belong to the
3 same locality, the medical evidence reflects that the injuries sustained are not life-threatening, the investigation has been completed and the charge-sheet has been filed, the applicant is in jail since 09.08.2026, and the conclusion of the trial is likely to take some time, without commenting anything on the merits of the case, I am inclined to grant regular bail to the present applicant. Accordingly, the bail application is allowed. 7. It is directed that in the event of the applicant executing a personal bond for a sum of Rs. 50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail, on the following conditions: (i) he shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts to the Court, (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, and (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. The observation made hereinabove is for the purpose of deciding this bail application only; the trial Court shall decide the case on its own merits without being influenced by any observation made in this
order.
