Sarfaraj Nawaj Mr. Tasnim Ahamed. …for the petitioner. Mr. L. Vishal Kumar Mr. Sanjib Das. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is innocent and has been falsely implicated in connection with the instant case. There has been alleged recovery of 515 grams of brown sugar and it has been alleged that the same was recovered from the possession of the petitioner. Charge-sheet has already been submitted. There is no possibility of the trial being concluded in near future, as such, the petitioner may be released on bail on any stringent conditions. Learned advocate for the State opposes the prayer for bail and submits that the other accused who has been released on bail there has been no recovery from the said accused. So far as the 2 present petitioner is concerned, there has been recovery from the present petitioner. The chemical examiner’s report do not support the petitioner as there are presence of Diacetylmorphine and 6- Monoacetylmorphine. Having considered the quantum of recovery in the present case and the same being allegedly from the present petitioner, I am of the opinion that this is not a fit case for granting bail as the rigors of Section 37 of the NDPS Act is attracted. Accordingly, CRM(NDPS) 1846 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
