(Oral) The prayer in the present petition preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’) is for the grant of anticipatory bail in case FIR No.0113, dated 27.05.2025, registered at Police Station Sadar Faridkot, District Faridkot, under Sections 21(a), 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’) (Sections 27 of NDPS and 303(2), 317(2), 345(3) of Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’) added subsequently). 2. On 03.08.2026, the following order was passed by this Bench:- “Prayer in the present petition preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the “BNSS”) is for the grant of anticipatory bail in case FIR No.0113, dated 27.05.2025 registered under Sections 21(a), 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short the “NDPS Act”) NEERAJ 2026.09.03 16:53 I attest to the accuracy and integrity of this document CRM-M-42503-2026 -2- (Sections 27 of NDPS and 303(2), 317(2), 345(3) of Bharatiya Nyaya Sanhita, 2023 (for short the “BNS”) added subsequently) at Police Station Sadar Faridkot, District Faridkot. On 27.05.2025, two persons namely Harveer Singh alias Veeri and Arshdeep Singh alias Arshu (present petitioner) are stated to have been apprehended and 3 grams of heroin is alleged to have been recovered from the petitioner. The petitioner was released on regular bail but subsequently Sections 27 of NDPS and 303(2), 317(2), 345(3) of BNS were added alleging that the motorcycle in possession of the petitioner was a stolen motor-cycle. Learned counsel for the petitioner submits that the petitioner had earlier been granted regular bail and now he apprehends arrest on account of certain other Sections, referred to above, having been added. He submits that the petitioner is willing to join investigation and abide by any condition imposed by the Court. Notice of motion. Mr. Ravinder Singh, DAG, Punjab accepts notice on behalf of the respondent-State.” List on 02.09.2026. In the meantime, the petitioner is directed to join investigation. In the event of arrest, he shall be released on interim bail to the satisfaction of the Arresting/Investigating Officer, subject to compliance of the provisions of Section 482(2) BNSS.” 3. Learned counsel for the petitioner submits that in compliance with the aforesaid order, the petitioner has duly joined the investigation. 4. In view of the above, the present petition is allowed.
