The said Crl.M.P.No.162 of 2026 was filed by the appellant / A2 under Section 483 of the BNSS seeking enlargement of the appellant / A2 on bail in connection with the offences punishable under Sections 5(m), (5(1), 6(1) and 21(1) of the POCSO Act, Sections 103(1), 238(a) of the BNS, and Sections 3(1)(a), 3(1)(w), 3(2)(va) of the SC/ST Act. 3. Heard the learned counsel for the appellant, the learned Government Advocate (Criminal Side) appearing for respondents 1 and 2 and the learned counsel appearing for the defacto complainant / intervenor. https://www.mhc.tn.gov.in/judis CRL A No. 650 of 2026 __________ Page3 of 6 4. The appellant appears to be a woman aged about 25 years and was married to the defacto complainant on 14.09.2020. Out of the said wedlock, a minor female child was born on 12.08.2023, who subsequently died on 11.12.2025. Owing to certain misunderstanding, the appellant and the defacto complainant had separated. The appellant, who has been arrayed as A2, is stated to have been residing with A1, who is said to be her relative aged about 41 years. 5. Since the death of the minor female child was suspected by the defacto complainant, a complaint came to be lodged before the Anchetty Police Station, which culminated in the registration of an FIR in Crime No.192 of 2025 on 12.12.2025. 6. The post-mortem report produced before this Court prima facie indicates the commission of aggravated sexual assault on a minor child by A1 during the period when the appellant was residing with A1 after separating from the defacto complainant. It also appears that A1 has admitted to the offence. Further, the appellant appears to have concealed the same by taking the minor child for treatment on earlier occasions. https://www.mhc.tn.gov.in/judis CRL A No. 650 of 2026 __________ Page4 of 6 7. The materials available on record further reveal that the investigation team has already filed a final report under Section 193 of the BNSS, 2023 before the jurisdictional Court, and the same has been taken on file in Special S.C.No.47 of 2026 by the Fast Track Mahila Court, Krishnagiri. 8. Since the Trial Court is now seized of the matter upon the filing of the final report under Section 193 of the BNSS. This Court is not inclined to grant any relief to the appellant at this stage. However, it is open to the appellant to approach the Trial Court for bail, if so advised. 9.
