Learned advocate appearing for the petitioner submits that the petitioner is unnecessarily languishing in jail for the last three years as the prosecution has failed to progress with the trial. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that out of 27 witnesses, prosecution has already examined 13 witnesses. I have taken into account the materials appearing in the present case which involved a minor being murdered and thrown in a goods train; mother of the victim is an eyewitness. Be that as it may, learned advocate for the petitioner has emphasised on the period of detention of the present petitioner. Having regard to the heinousness of the offence, I am not inclined to release the petitioner on bail at
2 this stage. As such, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after a period of six months. In the meantime, prosecution is directed to substantially progress with the trial of the case. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1752 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
