Order on Board 28.09.2026
1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) for grant of regular bail to the applicants in connection with Crime No.337/2026 registered at Police Station Mahasamund, District Mahasamund (C.G.) for the offence under Sections 109(1), 296 & 3(5) of BNS. 2. According to the prosecution, on 8.5.2026, at about 2:15 a.m., on Main Road, Mahasamund, the present applicant, along with three other co- accused persons, allegedly subjected the victim, Tomendra Chandrakar, to obscene verbal abuse and inflicted a grievous and life- threatening injury on his back with a sharp-edged iron knife, with the intention to cause his death. It is further alleged that the applicant had concealed the knife used in the incident at his waist and, upon encountering Tomendra Chandrakar at about 2:00 a.m., and owing to an old enmity, handed over the knife to his associate/co-accused (juvenile) with the intention of causing the death of Chandrakar. Thereafter, using the said knife, co-accused (juvenile) allegedly inflicted a blow on the back of Tomendra Chandrakar at a public place. It is further alleged that the incident occurred at the instance of the present applicant and that he played a major role in the commission of the alleged offence. Based on the said report, the present applicant was arrested in connection with the aforementioned crime. 3. Learned counsel for the applicant would contend that the main allegation is against the juvenile, who inflicted a knife injury on the back of the injured on 8.5.2026. He would contend that the present applicant has been falsely implicated in the case; the charge-sheet has already been filed; he has been in jail since 9.6.2026; he has no criminal antecedents; and the conclusion of the trial is likely to take some time. Therefore, he prays that the instant bail application may kindly be allowed. 4.
On the other hand, learned State counsel would contend that the present applicant provided the knife to the juvenile, who inflicted an
3 injury on the back of the injured. He would submit that the present applicant was actively involved in the commission of the crime. He would further submit that the filing of the charge-sheet would not dilute the gravity of the offence committed by the present applicant. He would also submit that the bail application filed by the applicant deserves to be dismissed. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Having considered the nature and gravity of the offence, the manner in which the offence was committed, and the fact that the present applicant allegedly provided the knife to the juvenile, who inflicted an injury on the body of the injured, and further considering the medical report, wherein the Medical Officer has opined that the nature of the injury was grievous and life-threatening, I am not inclined to allow this bail application. 7. Accordingly, the bail application of the applicant filed under Section 483 of BNSS, 2023 is rejected. Sd/-
