JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before the Court seeking the following prayers: In Crl.P.No.816/2026 "WHEREFORE, the petitioner named above prays that, this Hon'ble Court be pleased to call for records and quash the FIR in Crime No.474/2025 of Banaswadi police station, Benglauru City, now pending on the file of the Learned 4th Addl. CMM Court, Bengaluru registered for the offence punishable under sections 406 and 420 R/w 34 IPC, in so far as the petitioner herein is concerned, to meet the ends of justice." In Crl.P.No.15397/2025 "WHEREFORE, the petitioner named above prays that, this Hon'ble Court be pleased to call for records and quash the FIR in Crime No.388/2025 of Byadarahalli police station, Benglauru City, now pending on the file of the Learned Chief Judicial Magistrate (CJM) Bengaluru Rural District Bengaluru for the offence punishable under sections 506, 409 and 420 of IPC, to meet the ends of justice." This Court owing to the submission had granted an interim order in Crl.P.No.15397/2025 on 12.01.2026, which was further continued on 02.02.2026. The said orders read as follows: "Heard Sri.K.A.Chandrashekara, learned counsel appearing for the petitioner. - 5 - HC-KAR CNR: KAHC010039922026 NC: 2026:KHC:45963 CRL.P No. 816 of 2026 C/W CRL.P No. 15397 of 2025 Learned Addl.SPP is directed to accept notice for respondent No.1. Issue emergent notice to respondent No.2. The incident that happens on 1.8.2019 is sought to be complained in the year 2025 without any explanation for the delayin registering the crime. Therefore, permitting further proceedings would run foul of the judgment of the Apex Court in the case of CHANCHALPATI DAS VS. STATE OF WEST BENGAL, reported in 2023 SCC OnLine SC 650. In that light, there shall be an interim of stay of further investigation/proceedings in Crime No.388/2025 pending before the learned CJM, Bengaluru Rural District, Bengaluru qua the petitioner, till the next date of hearing." 2. The learned State Public Prosecutor submits that with the permission of the Court at a later point in time, the offence punishable under the Banning of Unregulated Deposit Schemes Act is also invoked, which is not brought to the notice of this Court, notwithstanding the fact that the same was brought to the notice of the concerned Court while securing an anticipatory bail. These are admitted submissions. 3. In the case of this nature, the Court is of the opinion that investigation must ensue. Since the petitioner has already granted anticipatory bail, the petitioner shall cooperate with the investigation.
