JUSTICE ANIL KUMAR CHOUDHARY ------ Order No:- 03, Dated:- 24th March, 2026 Heard the parties. The petitioner has moved before this Court for grant of bail in connection with Amrapara P.S. Case No. 63 of 2024 registered for the offences punishable under Sections 140(1), 3(5) of B. N. S. along with Section 12 of the POCSO. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed rape and aggravated sexual assault upon the minor victim girl. It is next submitted that the allegations against the petitioner are false and in the meanwhile, four witnesses have been examined during the trial including the doctor who conducted the medical examination of the victim and out of them, two witnesses have identified the petitioner during trial including the person who committed the offence. Hence, it is submitted that the petitioner be admitted to bail. Learned Addl. P. P. opposes the prayer for bail and submits that there is direct and specific allegation against the petitioner of aggravated sexual assault upon the minor victim girl as well as committing rape after kidnapping her. Hence, there is every chance of the petitioner absconding and tampering with the evidence if releasing on bail. Considering the serious nature of allegation against the petitioner as well as chance of the petitioner absconding and tampering with evidence, if released on bail, this Court is not inclined to admit the petitioner on bail at this stage.
