1. Affidavit of service filed on behalf of petitioner is taken on record.
2. By presenting this writ petition grievance is expressed on behalf of petitioner that based on complaint lodged by the petitioner FIR is yet to be registered. Petitioner prays for order thereby directing concerned police authorities to register FIR taking note of the complaint lodged.
3. Bank authorities and State respondents are represented by learned advocates.
4. Learned advocate representing State respondents on instruction submits that
2 husband of petitioner committed suicide which is corroborated by postmortem report.
5. Be that as it may, if complaint of petitioner is not transformed into an FIR there is an alternative remedy available to the petitioner under Section 175(3) BNSS, 2023 by approaching jurisdictional Magistrate. In this regard reliance is placed on the judgment of Hon’ble Supreme Court reported in (2007) 6 SCC 171 (Aleque Padamsee and Others vs. Union of India & Others).
6. In view of availability of alternative remedy present writ petition is not entertained and same stands dismissed.
7. However, this order shall not preclude the petitioner to approach jurisdictional Magistrate in pursuit of remedy.
