AG Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board
2 28.09.2026 1) Heard. 2) In MCRC No.8572/2026, the applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, he has been arrested in connection with Crime No.310/2026 registered at Police Station Darri, Korba (C.G.) for the offence under Sections 303(2), 317(4), 3(5) of BNS. 3) In MCRC No.8779/2026, the applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, he has been arrested in connection with Crime No.310/2026 registered at Police Station Darri, Korba (C.G.) for the offence under Section 303(2), 317(4) and 3(5) of BNS. 4) The case of the prosecution, in brief, is that on 11.08.2026, the present applicants, along with co-accused, namely Arun Nishad, committed theft of 40 stainless steel grade boxes from the HTPS, CSPGCL Power Plant, Darri, Korba. On the same day, the applicants were arrested and the stolen articles were seized from their possession. Initially, the police registered an FIR against unknown persons and, after investigation, arrayed three persons as accused in the present case. Hence, the bail applications. 5) Learned Advocates appearing for the applicants would submit that co- accused, namely Arun Nishad, has already been granted bail by the learned Trial Court on 25.08.2026. They would further submit that the charge-sheet has already been filed and the applicants are in jail since

It is also contended that the applicant Anad Ram @ Nandu has two criminal antecedents, out of which one is under Sections 294 and 506 of the IPC and is still pending, while the other is an Istagasha. As regards applicant Shambhu Prasad Kurre, there is one criminal antecedent for the offences punishable under Sections 305, 331(3), 317(2), 3(5) and 95 of the BNS, which is pending. They would further contend that co-accused Arun Nishad also had a criminal antecedent, despite which he was granted bail by the learned Trial Court on the ground of parity. Therefore, the applicants may also be enlarged on bail. 6) On the other hand, learned State counsel would oppose the bail applications and submit that the present applicants committed theft of 40 stainless steel boxes from the HTPS, CSPGCL Power Plant, Darri, Korba, and said stolen articles were seized at their instance. It is also argued that the applicants have criminal antecedents. Therefore, both bail applications deserve to be rejected. 7) I have heard learned counsel for the parties and perused the case diary. 8) Having considered the fact that criminal antecedents were registered against the applicants way back in the year 2021-2022, the charge- sheet has already been filed, the applicants are in jail since 11.08.2026, and co-accused, namely, Arun Nishad, has already been granted bail, without commenting upon the merits of the case, I am inclined to grant bail to the applicants. Accordingly, the bail applications filed under Section 483 of the BNSS, 2023, are allowed. 4
