1. Affidavit-of-service filed on behalf of petitioner is taken on record. 2. By presenting this writ petition challenge is thrown to propriety of the criminal prosecution being Sutahata P.S. Case no.263 of 2026 dated 25th July, 2026 registered under certain provisions of BNS, 2023. 3. Mr. Sandipan Ganguly, learned Senior Advocate representing petitioner in reference to complaint lodged and taking note of the facts of the case has submitted that the aforesaid proceeding is vexatious and frivolous and the object is to unleash political vendetta since petitioner was a Member of Legislative Assembly at the material point of time. 4. Mr. Rajdeep Mazumder, learned Additional Advocate General representing State respondents has opposed prayer of the petitioner upon placing certain documents. 5. While considering the issue involved in this writ petition, it appears to this Court that apart from the aforesaid criminal prosecution there were three other
[2] FIRs registered against petitioner and in connection with those three FIRs petitioner has obtained bail. 6. Since petitioner has obtained bail in other three FIRs, leave is granted to petitioner to approach appropriate forum for obtaining pre-arrest bail/ bail, in accordance with law. 7. However, taking note of apprehension expressed on behalf of petitioner that there might be other FIRs subsist as on date against petitioner, Deputy Inspector General of Police (Legal), West Bengal is directed to intimate petitioner by ten (10) days from date number of criminal prosecutions pending against him along with necessary particulars. 8. Writ petition stands disposed of. 9. However, it is made clear that points raised in this writ petition are not decided on merit. 10. Leave is granted to learned advocate representing petitioner to amend cause title of this writ petition and array Deputy Inspector General of Police (Legal), West Bengal as additional respondent in course of this day. 11. However, service of notice upon additional respondent stands dispensed with since State respondents are represented by learned Additional Advocate General. 12.
