JUSTICE RAVI V HOSMANI ORAL ORDER Challenging Charge sheet and entire proceedings in CC no.636/2019 on file of Addl.CJM, Bengaluru Rural District, Bengaluru for offences punishable under Sections 498A, 504, 506 read with Section 34 of Indian Penal Code, 1860 (IPC) and Sections 3 and 4 of Dowry Prohibition Act, 1961 (DP Act), this petition is filed. - 3 - HC-KAR CNR: KAHC010337962020 NC: 2026:KHC:47103 CRL.P No. 6240 of 2020 2. Sri Shekarappa, learned counsel for petitioners submitted that petitioners were arraigned as accused no.2 and 3 on complaint by respondent no.2 (complainant) on 18.05.2018. And petitioners were her parents-in-law. In complaint, she stated that she married Purushotham (accused no.1) on 21.05.2011 and from wedlock, two children were born. It was alleged that at time of marriage, complainant’s father had given motorcycle, gold bracelet, chain and Rs.5 Lakhs in cash as demanded. And sometime after marriage, accused ill-treated and assaulted her. That her husband would come home drunk, beat her with stick and also attempted to kill her on 17.05.2018. Thereafter, accused forcibly took away her gold, property documents and her son, leading to filing of complaint. It was submitted, same was registered as Crime no.205/2018 and after filing of charge sheet registered as CC no.636/2019. 3. It was submitted, petitioners were arraigned only to harass them, leading to this petition. It was submitted, during pendency of this petition, matrimonial dispute between complainant and accused no.1 got resolved in MC no.738/2023 on file of Prl.Senior Civil Judge, Bengaluru Rural District, - 4 - HC-KAR CNR: KAHC010337962020 NC: 2026:KHC:47103 CRL.P No. 6240 of 2020 Bengaluru by way of compromise decree on 20.12.2023. As per terms of settlement, complainant had agreed to co-operate for quashing of present proceedings. Therefore, seeks for allowing petition. 4. None appears for complainant. 5. Smt.Sowmya R., learned HCGP for respondent no.1 - State fairly submitted, taking note of above circumstances appropriate orders may be passed. 6. This petition is by accused no.2 and 3 challenging charge sheet and entire proceedings for offences punishable under Sections 498A, 504, 506 read with Section 34 of IPC and Sections 3 and 4 of DP Act. 7. Main grounds of challenge are that arraignment of petitioners is for harassment and thus abuse of process and on ground of settlement. 8. Hon'ble Supreme Court in innumerable cases observed general tendency to arraign all family members of spouse in case of matrimonial disputes, to exert pressure and cause harassment which is held to be abuse of process. - 5 - HC-KAR CNR: KAHC010337962020 NC: 2026:KHC:47103 CRL.P No. 6240 of 2020 9. Besides above, perusal of certified copies of petition, settlement agreement as well as order sheet in MC no.738/2023 produced along with memo today reveal conclusion of divorce proceedings between complainant and accused no.1 by way of compromise. Para 5 of compromise agreement is about consent/co-operation of complainant for quashing of present proceedings. 10. In view of above, as there would be no chance of conviction as well as on ground of securing ends of justice in view of settlement with complainant, petition is allowed. Charge sheet and entire proceedings in CC no.636/2019 on file of Addl.CJM, Bengaluru Rural District, Bengaluru for offences punishable under Sections 498A, 504, 506 read with Section 34 of IPC and Sections 3 and 4 of DP Act stand quashed qua petitioners (accused no.2 and 3).
