The State of West Bengal Mr. Angshuman Chakraborty, Mr. S.S.Saha …for the petitioners In this application, the petitioners have prayed for expeditious disposal of ACGR No.570 of 2021 presently pending before learned Judicial Magistrate, 9th Court, Alipore. Being aggrieved by and dissatisfied with the slow progress of the proceeding, learned Counsel for the petitioners submits that charge-sheet was submitted on 24th April, 2021 and charge was framed on 6th February, 2025. The prosecution proposes to examine four witnesses but till date not a single witness has been examined by the prosecution and for which the petitioners being the accused are suffering a lot. He, therefore, prayed for appropriate direction upon the Court below. Having heard learned Counsel for the petitioners and that the prayer made by the petitioners is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and as such service of copy of application upon the opposite party dispensed with. Having considered the submission made on behalf of the petitioners and that the proceeding has practically got stalled since 2 framing of charge, I find that the prayer made by the petitioners is justified and is required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 2778 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding being ACGR No.570 of 2021 presently pending before learned Judicial Magistrate, 9th Court, Alipore and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
