1 2026:CGHC:15834 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR CRMP No. 964 of 2026 Sunil Kumar Kashyap S/o Rajendra Kumar Kashyap Aged About 26 Years R/o Village- Dhobghatti, Police Station- Lormi, District- Mungeli, (C.G.) ... Applicant(s) versus State Of Chhattisgarh Through Station House Officer, Police Station- Pandariya, District- Kabirdham (C.G.) .. Non-applicant(s) For Applicant : None For Non-applicant/State : Ms. Smriti Shrivastava, Panel Lawyer. Hon'ble Shri Ramesh Sinha , Chief Justice Order on Board 07.04.2026 1. This is an office reference. 2. This Court, vide order dated 13.10.2025 passed in MCRC No. 7177 of 2025, while allowing the bail of the applicant, namely, Sunil Kumar Kashyap had expressed its trust that the trial Court would make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of that order, if there was no legal impediment. 3. The learned Additional Judge, Pandariya to the 1st Civil Judge KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 Senior Division, Kawardha District-Kabirdham (C.G.) vide her request letter dated 20.03.2026 has requested for grant of eight months time for concluding the trial. 4. It transpires from perusal of the PUD that in the present case, the evidence of approximately 60 prosecution witnesses have already been completed, whereas a total of 94 witnesses have been cited in the charge- sheet. During the course of trial, a supplementary charge-sheet has been filed against the applicant, Lalit Singh Thakur. In this regard, on 19/03/2026, arguments on the point of charge as well as on the objection application filed by the counsel for the newly added accused were heard, and the matter was posted for orders on charge and for disposal of I.A. No. 01/26 on 27/03/2026. It further transpires from the record that, upon filing of the supplementary charge-sheet against the newly added accused, a fresh phase of trial has become necessary. There is a requirement to recall and re-examine the witnesses already examined, some of whom are residing in other States. The supplementary charge- sheet filed against the newly added accused cites 30 witnesses and the total number of witnesses, as reflected in the original as well as additional supplementary charge-sheets, has increased to approximately 124. In view of the aforesaid circumstances, it is evident that delay in disposal of the case is inevitable and it does not appear feasible to conclude the trial by 15/04/2026. Accordingly, for the proper and effective adjudication of the case, an additional period of eight (08) months is required. Hence, it is respectfully prayed that this Court may be pleased to grant an extension of eight months for final disposal of the case. 5. The request made by the learned trial Court, is allowed, however, 3 instead of granting eight months, this Court deems it appropriate to grant further 05 months time for concluding the trial from today. 6. Accordingly, this CRMP stands disposed off with the aforesaid direction. 7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/- (Ramesh Sinha) Chief Justice Kunal
