Ganguly Mr. Kaustav Bhattacharya ….for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Additional District Judge, 4th Court at Howrah to dispose of the Title Appeal No.50 of 2021 expeditiously. From the order sheets appended to this application, this Court finds that September 11, 2026 is fixed for bringing the trial court record and for hearing of the appeal. The learned advocate appearing for the petitioners submits that the trial court records are yet to arrive before the learned appellate court. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned judge of the appellate court. In the light of the submissions made by the learned advocate for the petitioners, CO 2900 of 2026 stands 2 disposed of by requesting the learned Additional District Judge, 4th Court at Howrah to take steps and ensure that the trial court record reaches the appellate court on or before the next date fixed for hearing of the appeal. If however, the trial court records do not reach the appellate court before September 11, 2026, the learned Additional District Judge, 4th Court at Howrah shall make an endeavour to see that the trial court records reaches the appellate court by the end of the month of September, 2026. The learned Additional District Judge, 4th Court at Howrah shall make an endeavour to take up the hearing of the Title Appeal No.50 of 2021 immediately after the same is made ready for hearing and make an endeavour to dispose of the same as expeditiously as possible but preferably within a period of 6 months from the date the title appeal is made ready for hearing. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
