ORDER This Writ Petition has been filed for the following reliefs:-
“ directing the Respondents to provide the monetary benefits and arrears under Career Advancement scheme to the petitioners in tune with the order passed by the Hon’ble Madurai bench of Madras High court in W.P. (MD) No 22547 of 2024 dated 23.9.2024 and confirmed by the Honble Division Bench by
order dated 11.07.2025 in W.A. (MD) Nos. 1875 of 2025 etc, within the time period stipulated by this Honble Court.”
2. It is the case of the petitioners that they are working as Associate Professors in Government Aided Colleges under the jurisdiction of the third respondent. They were granted promotion as Associate Professors in Academic Level 13A under the Career Advancement Scheme (CAS) during the years 2023 and 2024. However, though the promotions were granted, the monetary benefits attached thereto have not been disbursed. 3. The petitioners would submit that, similarly placed Associate Professors working in Government and Aided Colleges across the State have been extended the monetary benefits under the CAS, whereas the same has been denied to Associate Professors working in Aided Colleges under the Tirunelveli and Madurai Regions. https://www.mhc.tn.gov.in/judis

The petitioner would further submit that, in respect of similarly placed persons, this Court had granted similar relief in W.P.(MD) Nos.22547, 23858, 23859, 23860, 23861, 23862 and 23863 of 2024, which was subsequently confirmed by the Hon’ble Division Bench in W.A.(MD) No.893 of 2025 and connected cases, and the Special Leave Petition preferred by the Department against the said orders was dismissed by the Hon'ble Supreme Court. 5. In these circumstances, the petitioners had submitted a joint representation dated 27.04.2026 to respondents 1 to 3 seeking disbursement of the monetary benefits and arrears under the Career Advancement Scheme. Since the same has not been considered to date, the present Writ Petition has been filed. 6. Heard the learned counsel on either side and perused the materials available on record. 7. This Court, by a common judgment dated 11.07.2025 in the batch of writ appeals in W.A.(MD) No. 1875 of 2025 had observed as follows:-
“3.It is seen that the writ petitioners are working as Assistant Professors in various disciplines in Urumu Dhanalakshmi College, Trichy. They wanted to be conferred with the benefit set out in Career Advancement Scheme. WP No. 20928 of 2026 __________ Page5 of 7 passed order for conferring the said benefits of scheme on the writ petitioners. But it was not implemented. Hence, the writ petitioners filed Writs of Mandamus. The learned Single Judge allowed all the writ petitions.
Questioning the order passed in one such writ petition ie., W.P.(MD)No.22547 of 2024, the department filed W.A.(MD)No.893 of 2025. The Hon’ble Division Bench vide order dated 03.04.2025 dismissed the writ appeal in the following terms:-
“5.On perusal of the materials available on record, it is seen that the Career Advancement Scheme (CAS) benefits were conferred upon the writ petitioner with effect from 07.12.2017 and the monetary benefits with effect from 01.08.2018 by the proceedings of the second respondent in RC.No.7986/A2/2023~4, dated 11.01.2024 and the writ Court has rightly directed the second respondent to implement the
order dated 11.01.2024. Hence, we are not inclined to interfere with the order passed by the writ Court, dated 23.09.2024.” 4.The cases on hand are absolutely identical. When a coordinate Division Bench has taken a particular view, we do not want to take a different view. These writ appeals are dismissed with the same directions. No costs. 8. The aforesaid judgment dated 11.07.2025 squarely applies to the facts of the present case. Accordingly, this writ petition is allowed. The respondents are directed to consider the petitioners’ case in the light of the orders passed by this Court in WA.(MD) No.1875 of 2025 (Batch) and pass appropriate orders in accordance with law. The said exercise shall be completed within a period of 6 weeks from the date of receipt of a copy of this order.
