Rakib (Rejected) CRM (A) 2828 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Barasat Cyber Crime Police Station case no. 12 of 2026 dated 15.05.2026 under Sections 316(2)/318(4)/61(2) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Atanu Das ……Petitioner. Mr. Mohammed Amin Mr. Ghulam Muztaba Mr. Iqbal .....for the Petitioner. Mr. Arindam Dey Mr. Ushm Garodia ……for the State. Learned advocate appearing for the petitioner submits that petitioner is an employee of an investment company. It has also been emphasized that amount was received by the complainant in spite of the same the case has been registered and the accusations are principally against Arindam Roy and petitioner has been falsely implicated in the present case. Learned advocate appearing for the State opposes the prayer for anticipatory bail and submits that after the loan amount was transmitted, the same was transferred to the account which is controlled by the accused persons which is also stated in the FIR. Similar types of offences have been committed and it appears that petitioner and Arindam Roy both have been implicated in connection with New Market PS Case no. 79/2026, Netaji Nagar PS Case no. 136/2026 and there are other complaints also pending before the NCRP Portal. 2 Having considered the number of cases against the present petitioner, I am of the view that police authorities will require the petitioner for the sake of investigation. As such, prayer for anticipatory bail of the petitioner in CRM (A) 2828 of 2026 is rejected. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
