D/L252 31.08.2026 Bpg. C.R.M. (M) 1509 of 2026 In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Chhatna Police Station Case No.126 of 2025 dated 10.11.2025 under Sections 70(2)/351(3) of the Bharatiya Nyaya Sanhita, 2023 read with under Section 6 of the Protection of Children from Sexual Offences Act, 2012; Subrata Soren Versus The State of West Bengal & Anr. Mr. Arup Kundu. ...for the petitioner. Mr. Pinaki Bhattacharyya. …for the State. Mr. Abhinav Rakshit. …for the de facto complainant. Learned advocate appearing for the petitioner submits that the petitioner is innocent and has been foisted with the criminal case. Learned advocate for the de facto complainant opposes the prayer for bail. State has produced the case diary and drawn the attention of the Court to the statement of the victim under Section 183 of the BNSS. I have taken into account the statement of the victim and I find that the petitioner has been specifically named by the victim. Further, the case substantiate the materials under Section 70(2) of 2 the BNSS. Having considered the same, I am of the opinion that this is not a fit case for granting bail to the petitioner prior to the evidence of the victim being concluded. Accordingly, CRM(M)1509 of 2026 is dismissed. Learned trial court is directed to overcome the process of consideration of charges within a period of one week from the next date fixed and thereafter within a period of 60 days complete the evidence of the victim. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
